1. ACCEPTANCE OF TERMS
The purchase of any tours offered by through www.esgoaddistours.com (hereinafter referred to as “The channel”) constitutes a contractual agreement between you and (hereinafter referred to as “The Owner”) and represents your acceptance of the terms and conditions set out herein. Please ensure that you have read, understood and accepted these terms and conditions prior to booking.
By accessing and using this service, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.
“The Owner” reserves the right to change the Terms, at any time, without notice. Your failure to follow these Terms may result in suspension or termination of your access to the Service, without notice.
2. LANGUAGE OF THE TERMS
“The Owner” has provided you with the English-language version of the Terms; you agree that the English-language version shall govern your relationship with “The Owner”. Should there exist any contradiction between the English-language version and a translation, the English-language version shall take precedence.
3. TERMS OF PARTICIPATION
Participants must identify themselves at the check-in before the Tour start by showing their ID or passport according to the booking; otherwise, TO may exclude participants for whom the booking was made from the Tour without refund of the purchasing price. Minor Customers must be accompanied by a person having the power of representation. Coaches are not equipped with a ramp. Disabled Customers who need assistance in getting on and off the coach are requested to organize such assistance themselves. Pets are not allowed on all tours. Customers undertake to inform “The Owner” of any health problems. Adequate health and accident insurance coverage is the responsibility of the Customers (including supplementary insurance against sports accidents in case of Tours with sports activities). Joining a Tour under the influence of drugs, medicines and/or excessive alcohol is not permitted. Customers undertake to strictly comply with the terms of participation of third-party providers, the instructions of “The Owner”, of third-party providers, of support staff as well as external Tour guides and rescue staff. Furthermore, Customers are obliged to wear seat belts and to use child safety seats, if applicable. “The Owner” reserves the right to exclude a Customer from the Tour with immediate effect in case of health problems, non-compliance with the terms of participation or violation of these terms or any instructions. In case a minor Customer is excluded, the accompanying person is also excluded from the Tour. In case the exclusion is made prior to the Tour start, the terms of cancellation apply analogously. In case the exclusion is made during a Tour, the Customer has no right to a refund of the Tour Price. In case of exclusion, any and all claims for damages against “The Owner” are excluded.
If the Customer is not present in time at the departure respectively meeting point for the start of or during the Tour, “The Owner” reserves the right to exclude the Customer from the Tour after a waiting period of 5 minutes for a half-day Tour or 10 minutes for a day Tour and to depart without the Customer. In this case, the Customer is neither entitled to a refund of the Tour Price nor may the Customer claim any damages. Furthermore, Customer must pay for any additional costs (e.g. transportation back to the starting point) by him- or herself.
“The Owner” will never sell your personal information to any third party. We reserve the right to use data given to us for marketing and research purposes.
5. BOOKING TOURS
“The Owner” operates on a first-come-first-served basis. To make a booking inquiry, please complete the Booking Form. All booking correspondences will be carried out via email or telephone. We accept no responsibility for incorrect email addresses provided by you or failed email delivery attempts.
For all tours on “The channel”, fees vary according to the areas covered, the duration of the tour as well as the number of people who are on the tour. If there are any changes, please let us know in advance. Please do not add participants on your own accord. We reserve the right to turn the extra participants away and/or to impose additional charges accordingly.
6. RATES AND TERMS OF PAYMENT
The Tour price per person (hereafter "Tour Price") is stated the price list in American Dollars. Prices are subject to change according to section 7. The Tour Price is due at the time of booking.
Free tours are intended for the enjoyment of small groups (fewer than ten), and individual travelers. The tours are operated free 100%. Pre-booking is mandatory.
7. CHANGES IN TOUR PRICES OR SERVICES
“The Owner” reserves the right to change the Tour Price according to the price list or the agreed Tour Price, respectively, in case of extraordinary circumstances. Extraordinary circumstances are in particular:
- changes in the rates of third-party providers, e.g. of transportation companies
- newly introduced or raised taxes, charges or fees
Changes in Tour Prices in case of extraordinary circumstances are communicated 3 weeks prior to the Tour start at the latest. If the difference between the new and the initial Tour Price exceeds 10%, the Customer is entitled either to withdraw from the contract upon written notice within 5 days after communication of the change in Tour Prices against full refund of any Tour Price already paid or to book an alternative Tour from “The channel” in the value of the initially booked Tour without any rebooking fee. Further compensation for damages is excluded.
“ The Owner” reserves the right to change the Tour program at any time, prematurely curtail the Tour or offer alternative solutions in case of extraordinary circumstances. Any additional costs of the Tour shall be borne by the Customer. “The Owner” undertakes to immediately inform the Customer of any changes in services and/or in the program. If the alternative solution is more expensive than the initially booked Tour or unreasonable for the Customer, Customer is offered withdrawal free of charge. Refunds are effected in the same way as payment has been made. Further compensation for damages due to change(s) in Tour Prices or services is excluded.
8. CANCELLATION AND CANCELLATION POLICY
Cancellations made by Participants
Cancellations made by the participants must be made in writing, via email to us. The following cancellation fees apply to all of the tours on “The channel”:
- Cancellation made within 72 hours – 168 hours (i.e. 3 – 7 days), prior to time of tour: 50% of total fees paid.
- Cancellation made less than 72 hours (i.e. 3 days), prior to time of tour: 100% of total fees paid.
- No-Show (i.e. 30 minutes after the tour’s starting time): 100% of total fees paid.
Please note that no refunds will be made if a participant chooses to leave a tour in progress or chooses not to turn up for the tour.
Cancellations made By “The Owner” or “The channel”
In the event of any cancellation made by us, for whatever reason, the fees will be refunded in full.
9. THIRD PARTY TOURS, ACTIVITIES AND ADDONS
“The Owner” and its affiliated entities and its employees, shareholders, officers, directors, successors, agents, and assigns, neither own nor operate any person or entity which is to, or does, provide goods or services for these trips or tours. Because “The Owner” does not maintain any control over the personnel, equipment, or operations of these suppliers, “The Owner” assumes no responsibility for and cannot be held liable for any personal injury, death, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned by reason of (1) any wrongful, negligent, willful, or unauthorized acts or omissions on the part of any of the tour suppliers, or other employees or agents, (2) any defect in or failure of any vehicle, equipment, instrument owned, operated or otherwise by any of these suppliers, or (3) any wrongful, willful, or negligent act or omissions on any part of any other party not under the supervision or control of the “The Owner”
“The Owner” does not assume any liability for damages based on circumstances that are beyond its control, such as force majeure, natural events, catastrophes, civil or political unrest, changes in program due to non-adherence of train, bus or ship transportation companies or other third-party providers to their schedules, etc. Customer undertakes to claim any damages directly from the third-party provider.
10. PERSONAL FITNESS AND PERSONAL ACCIDENT INSURANCE
Participants are responsible for ensuring they are in suitable physical condition for all tours provided on “The channel”. If you have any doubts on your level of personal fitness, you must consult your doctor. All tours displayed on “The channel” require walking. Any medical condition or medication being taken that may affect your health or participation must be notified to us in writing prior to the event and must be accompanied by a doctor’s certificate to verify your fitness to participate in any tour.
All events are undertaken at the participants’ own risk. We accept no liability or obligation in the event of illness, injury, death or loss or damage to personal property.
11. PERSONAL CONDUCT
For the benefit of everyone, we reserve the right to remove any participant whose conduct is deemed to pose a risk or nuisance to others. We will not refund or cover any cost or expenses incurred due to unacceptable behavior.
12. FOOD AND BEVERAGE
Unless stated otherwise, all food and beverage consumed during a tour is the responsibility of the participant. We accept no responsibility or liability in this instance.
13. PHOTOGRAPHS AND PHOTOGRAPHY
Photographs or pictures appearing on this website should be used solely as an indication of attractions. Actual attractions may vary according to the itinerary as well as the tour you have chosen.
We reserve the right to photograph/film any event and participants, as well as to use any of such images for promotion and/or commercial purposes without further recourse or compensation.
When taking still photographs please be considerate of others in group as well as those on the street you may be photographing. “The Owner” does not permit video or audio taping of any kind and we strongly discourage note taking.
Tours generally runs rain or shine. “The Owner” reserves the right to cancel tours in the event of potentially dangerous weather.
All information provided on “The channel” is correct, to the best of our knowledge, errors, omissions and exceptions notwithstanding. We do not assume responsibility or any liability for any participant’s own misunderstanding or misinterpretation of any information provided on this site.
